The Desert Hot Springs City council has turned against its own citizens. The same people have been on this council for years. In about 2016 Desert Hot Springs found that it could "tax" its citizens using "administrative citations." The city began its code enforcement division. Since then it has escalated enforcement by adding to its "public nuisance" list of violations. Realistically, just about anything can fit into these nuisance laws. Because of that Desert Hot Springs code compliance officers can fine you for just about anything. And they do - a low tire in your own driveway, working on your car on your own property, parking your boat or your recreational vehicle, weeds, your fence, a cracked window glass, and some much more.

The whole scheme is a racket to make money. A group of concerned citizens plan to file a class action lawsuit against the City and every code enforcement officer who has participated in the racket. How about 45.D? - Every owner, occupant, lessee or holder of any possessor interest of real property within the City is required to maintain such property so as not to violate the provisions of this chapter! The City of Desert Hot Springs has gone way too far harming its own citizens with these laughable public nuisance declarations. Its time to fight back and lose this code. This law could not be more vague or abusive.

In about 1994 the city of San Jose California sponsored a bill in the legislature to create the creature known as an administrative citation. Senate Bill 814 introduced government code 53069.4. This statute gives local entities the authority to create law, enforce law, fine citizens, and collect all the money. This was supposed to be a simple solution to minor violations such as a garbage can in the street.

Attorney Joan Gallo, bless her little heart, trumpeted this new technique to the league of California cities making it known throughout the state. Three decades later cities have taken this ability and twisted it to mean they can do whatever they want with you. And then they can give you a whopping fine.

The problem for citizens is that no one is watching the city's. Yes, they can make law, and they can enforce the law they make. However they have forgotten to make any law whatsoever that assists in any way a citizen to put up a defense. Isn't that interesting.

The legislature, probably knowing that cities would take advantage of their newfound power, gave the person who had been cited the right to challenge the administrative hearing officer's finding and reclassify then move the entire case to civil court limited civil jurisdiction.

You will have a better chance of winning if you move the case to limited civil jurisdiction, after you have your administrative hearing.

You will be caught off guard. They make these laws for a purpose - to make it hard to oppose them.

When you get first notice or citation IMMEDIATELY start your research. SAVE every envelope, every piece of paper.

You must pay fine or get fine waiver. If you decide to fight, and you should, you will need to APPEAL to a hearing officer.

There is no more fine if you APPEAL to a hearing officer (NO ZOOM HEARINGS) than if you just pay the citation.

If everyone forces the City to pay for hearing officers then they may end this evil practice. You can not submit new evidence at a zoom hearing.
